June 5, 2015 – Another lawsuit filed in San Diego this time against Diageo, owners of Bulleit Bourbon. The lawsuit claims false advertising over the phrase “Distilled, Aged & Bottled by the Bulleit Distilling Co. in Lawrenceburg, Kentucky,” which implies it was distilled in Lawrenceburg, KY but Diageo does not own a distillery in Lawrenceburg. It has been using the Four Roses distillery operating under a long-term contract that terminated about a year ago. Diageo has since been sourcing raw spirit from an undisclosed Kentucky distillery.
A Diageo spokesperson said the company will vigorously defend the suit which she described as “baseless and frivolous”. “Bulleit Bourbon labels comply with all laws and regulations,” she said.
Oh, and did we mention that the law firms behind this latest suit also filed similar cases against Jim Beam and Maker’s Mark in the same U.S. district court?
A lawsuit with a different twist concerns Angel’s Envy Bourbon, which was sold by its co-founders Lincoln and Wesley Henderson to Bacardi. Cecilia Henderson, widow of Lincoln, is suing her son, Wesley over her husband’s share of the proceeds which were supposed to come to her according to her husband’s will. Mrs. Henderson claims her son has “effectively stolen” the proceeds and that he “has stated to others his intent to purchase exotic luxury cars and vacation homes”. Wesley Henderson denies his mother’s claims as baseless and defamatory.
