Arsenic in Wine Lawsuit Disappoints Lawyers

July 22, 2015 — Back in March we reported on a lawsuit filed against 28 California wineries for the levels of arsenic in their wines. The class action suit was brought by Burg Simpson Eldredge Hersh & Jardine, P.C. in Los Angeles. None of the wines named in the suit has been recalled and retailers are still selling all 83 brands involved in the suit.
The lawyers are disappointed. The clink of all that cash jingling around in those deep pockets is getting awfully quiet. Why? To quote from our earlier story, “….the U.S. does not have specific acceptable levels for arsenic in wine, other countries do and California wines have never come close to exceeding those levels. But the lawsuit is still going forward and consumers are being recruited to sign on. What will be your reward? Some kind of limited reimbursement. Most of the wines are priced under $10. Only the lawyers will get rich and, of course, they still have to win the lawsuit.
